A properly drafted Power of Attorney drafted in some state other than new Hampshire, will still be valid here with one proviso: if the Agent actually needs to use that document, the Agent must sign a new Acknowledgement. This is a form that the Agent signs acknowledging that he or she is a fiduciary and must only use the powers granted in the POA for the Principal’s best interest.If you have an out-of-state Power of Attorney, we would be happy to review it for you and prepare the Acknowledgement if it is needed.
