Probate and Trust Litigation

Probate Litigation

Probate Litigation involves resolving Probate disputes through the court system. Common disputes involves determining the validity of a decedent’s Wil or reviewing undue influence claims. Our Firm will review the merits of each client’s case and zealously advocate for them. Such Litigation can include:

    • Breach of fiduciary duty claims against executors, personal representatives and trustees
    • Legal actions to remove executors, personal representatives and trustees for wrongdoing
    • Interpretation of estate planning documents
    • Will contests
    • Lack of testamentary capacity claims
    • Will forgery claims
    • Undue influence claims

 Trust Litigation

Trust Litigation becomes necessary when problems arise during the funding or administration of a Trust. Trustees or beneficiaries may have grievances that need to be resolved, such as wanting a Trustee to be removed or to enforce a distribution under the Trust. Our Firm will help counsel its clients through this process.
